Iraq's top court ratifies election results, declares secularist Iraqiya bloc biggest winner

BAGHDAD - Iraq's Supreme Court on Tuesday ratified the results of the nation's March 7 parliamentary election, officially declaring the secular Iraqiya alliance the vote's biggest winner.
The televised announcement by the court's top judge marked the first major step toward resolving Iraq's election crisis and the seating of a new parliament. But the government impasse remains far from over, and it could still take weeks, perhaps months, before lawmakers elect new leaders.
The March vote left the country without a clear winner, as none of Iraq's major political coalitions won an outright majority in the 325-seat legislature.
The confusion has led to nearly three months of ballot recounts, charges of fraud and court challenges, nearly all of which brought by the State of Law alliance led by Prime Minister Nouri al-Maliki.
In announcing the ruling Tuesday, judge Midhat al-Mahmoud called the vote results submitted May 26 by the Independent High Electoral Commission "reliable." Based on that, he said, "we decided to ratify the final results of the general parliament elections for 2010," he told a news conference at the Supreme Court.
Iraqiya, heavily backed by Iraq's once-dominant Sunni Arab minority, is led by former Prime Minister Ayad Allawi, a secular Shiite. Iraqiya won 91 seats, two more than al-Maliki's State of Law.
Iraq's next government will oversee the departure of U.S. troops from Iraq. The number of American forces is due to shrink to about 50,000 by the end of August. A security agreement requires all U.S. troops to leave by the end of 2011.
Many Iraqis — as well as U.S. and U.N. officials — have expressed frustration with the legal wrangling that has delayed the court's final election approval.
According to the Iraqi constitution, President Jalal Talabani now has 15 days to call parliament to its first session, where lawmakers could vote to elect a speaker and a president of the republic.
The new president will have another 15 days to declare the largest power bloc, based on the number of seats it holds. The new bloc will in turn name the next prime minister and proceed to piece together a new government.The bloc that is selected to form the government — a process that could take months — will be able to reward allies with Cabinet seats and top government jobs.However, in a March 25 legal opinion, the Supreme Court left open the question of whether the biggest bloc would be that which won the most seats in the March vote, or if it could be one formed after the balloting.Last month, al-Maliki's State of Law bloc agreed to join forces with the religious Iraqi National Alliance to form a so-called "super-Shiite" coalition of a combined 159 seats. That's still four seats shy of capturing a simple majority in parliament.It's expected that Iraqiya and the super-Shiite coalition will now battle over which should be legally considered the largest bloc in parliament — a fight that could be drawn out.In a statement, the U.S. Embassy in Baghdad called Tuesday's court ruling "an important step in the right direction as Iraq undertakes what will be a historic and peaceful transition of power from one elected government to another.""Now is the time for all political leaders to come together to put the interests of the Iraqi people foremost in their negotiations over the makeup of the new government," the Embassy statement said.>___AP reporters Qassim Abdul-Zahra, Hamid Ahmed, Adam Schreck and Lara Jakes contributed to this report.

UPDATE Federal respalda la corte resultados de las elecciones

BAGDAD / Aswat al-Iraq: Supremo Tribunal Federal de Irak anunció el martes que aprobó los resultados del 07 de marzo las elecciones legislativas.

"El tribunal confirmó los resultados definitivos de las elecciones del Consejo de Representantes para el año 2010 como por los documentos de la Comisión Electoral Independiente Superior (IHEC)," El juez Medhat al-Mahmoud, el jefe del Consejo Superior de la Judicatura, dijo durante una conferencia de prensa que ofreció en Bagdad hoy (01 de junio).

"La decisión fue adoptada de conformidad con lo dispuesto en el párrafo 7 del artículo 93 de la Constitución de la República de Irak", dijo.
aprobación de la corte de los resultados electorales de la PAC más de 73 días de polémica que siguió al 07 de marzo las elecciones que decidieron los 325 miembros del Consejo de Representantes que se elegirá al primer ministro iraquí y el presidente.
La elección resultó en una victoria parcial para el Movimiento Nacional Iraquí (Iraqiya), liderado por el ex primer ministro interino, Iyad Allawi, que ganó un total de 91 escaños, convirtiéndose en la mayor alianza en el Consejo.

El Estado de Derecho, dirigido por el primer ministro Maliki titular, fue la agrupación más grande en segundo lugar con 89 escaños.
El 15 de enero de 2010, el IHEC prohibido 499 candidatos de la elección, debido a supuestos vínculos con el Partido Baas. Antes del inicio de la campaña el 12 de febrero de 2010, la IHEC confirmó que los recursos de casación por los candidatos prohibidos habían sido rechazadas y por lo tanto todos los 456 candidatos prohibidos no se le permitiría postularse para la elección.

Un recuento de los votos en Bagdad fue ordenada el 19 de abril de 2010. El 14 de mayo, el IHEC anunció que después de 11.298 urnas habían sido relatados, no había señales de fraude o violaciónes.
Anteriormente, una fuente cercana al Maliki, el líder de la Dawlat al-Qanoon (Estado de Derecho) del bloque, dijo Maliki, dio instrucciones para retirar todos los concursos transmitido por su bloque en contra del resultado de las elecciones parlamentarias.
